THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10622 OF 2017 ORDER:
The proceedings issued by the 2nd respondent, dated 03.03.2017, revoking the building permission issued to the petitioner, are challenged in this writ petition on the ground of mis-representation of facts. The principal ground on which the challenge is based is that even as per the impugned order, a show cause notice is alleged to have been issued on 03.03.2017 and on the same day, the impugned order came to be passed, thereby indicating totally non-application of mind. On being pointed this anomaly, learned Standing Counsel for the 2nd respondent submits that the impugned order may be set aside by giving liberty to the 2nd respondent authorities to take action in accordance with law, since the petitioner is making construction in the land belonging to the Taluka High School.
In view of the submissions of the learned Standing Counsel, the writ petition is allowed and proceedings, dated 03.03.2017, passed by the 2nd respondent are set aside and liberty is given to the 2nd respondent authorities to take action in accordance with law. No order as to costs. As a sequel to disposal of the writ petition, W.P.M.Ps., if any pending, shall stand closed. _____________________ CHALLA KODANDA RAM, J March 27, 2017 KTL
