HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN WRIT APPEAL No.280 OF 2017 JUDGMENT (ORAL) : Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have heard the learned counsel for the appellant, which is a Labour Cooperative Society.

2. Learned Government Pleader for Endowments takes notice for respondent Nos.1 and 3, and Sri Kasa Jaganmohan Reddy, learned standing counsel, takes notice for respondent No.2.

3. The contention of the appellant before the learned single Judge was that in terms of G.O. Ms. No.398 dated 05.09.1990 and G.O. Ms. No.52 dated 18.03.2000, certain concessions are provided to societies like the petitioner, which are societies of the Scheduled Castes, the Scheduled Tribes and Backward Classes etc., as the case may be. The learned single Judge noticed that the various concessions provided through those Government Orders do not disclose that they have been made applicable to the temples and other endowment organizations. Therefore, the learned single Judge held that the benefit of those Government Orders cannot be enjoyed by the petitioner in relation to Sri Raja Rajeswara Swamy Devasthanam, Vemulawada in Karimnagar District, which is respondent No.2, and other endowment organizations.

4. There is no interlocutory order in favour of the appellant during pendency of this writ appeal.

5. We do not see any ground to interfere with the view taken by the learned single Judge. We also noticed that the tender notice that was impugned before the learned single Judge relate to the year 2017. However, according to the learned counsel for the appellant, the appellant - writ petitioner is continuing to enjoy the benefit of being given the contract for the work. We record this without prejudice to the rights and contentions of respondent No.2.

6. The Writ Appeal fails and the same is dismissed accordingly. No order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending stand dismissed.
