Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) One of the guarantors of the loan obtained by respondent No.2 from respondent No.1 filed this Writ Petition feeling aggrieved by Order, dated 15-06-2016, passed by respondent No.10- Debt Recovery Tribunal whereunder it has directed respondent No.1 to deposit with its Registrar the document of title earlier deposited with it in connection with the sanction of loan to respondent No.2 to consider the plea of subrogation raised by respondent Nos.3 to 5.

The necessity of adjudication of this Writ Petition on merits is obviated for the reason that the impugned order is interim in nature and the case stood posted to 17-08-2016 from 15-06-2016, the date on which the said order was passed by respondent No.10.

Mr.N.Subba Rao, learned Counsel for the petitioner, submitted that his client has already filed a counter-affidavit and that since respondent No.10 has not passed further order after the petitioner filed his counter-affidavit, the latter is constrained to file this Writ Petition.

In the light of this grievance of the petitioner, it would suffice if a direction is issued to respondent No.10 to dispose of the interlocutory application filed by respondent Nos.3 to 5 after considering the respective pleadings of the parties and hearing the Counsel representing them expeditiously. Accordingly, respondent No.10 is directed to dispose of the interlocutory application within two months from the date of receipt of this order.

Subject to the above direction, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.37138 of 2016, filed by the petitioner for interim relief, is disposed of as infructuous.
