THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24895 of 2014 ORDER:
Heard Sri M.Durga Prasad for petitioner and Assistant Government Pleader for Irrigation for respondents. The petitioner complains against inaction of respondents firstly in disposing of representation, dated 21-07-2014 and secondly not removing illegal encroachments in Nekanampuram Tank and its canals viz., Pedda Vanka, Yerravanka and J.D.Vanka situated at Siddavatam Mandal, Kadapa District, as illegal and unconstitutional. The Assistant Government Pleader, at the time of hearing, submits that respondents did not so far send instructions in the matter. However, keeping in mind, the complaint against inaction in protecting water body, the respondents can be directed to dispose of representation, dated 21-07-2014 and also take steps for removing encroachments, if any, in accordance with law.
The statement is accepted and I am satisfied that the writ petition can be disposed of by this order:- The petitioner is given liberty to resubmit representation, dated 21-07-2014 along with a copy of this order to respondent 3 to 5 within four weeks from today. On receipt of representation, 5th respondent is directed to inspect the subject tanks, enquiry into the grievance brought by the petitioner and if in the enquiry it transpires that there are encroachments of subject tanks, respondents 3 to 5 are directed to act in accordance with law and remove encroachments as expeditiously as possible, preferably within three months from the date of inspection.
The writ petition is disposed of, as indicated above. No order
as to costs.
