THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTY Crl.A.M.P.No.1225 of 2014 in Crl.A.No.1044 of 2011 ORDER (Per the Hon'ble Sri Justice M. Satyanarayana Murthy) The convict (accused No.2) in Crl.A.No.1044 of 2011 is filed this petition to enlarge him on bail on the ground that he has to look after the marriage arrangements of his sister scheduled to be performed on 15.08.2014 and that his grand mother, who is aged 74 years, is suffering from ill-health, undergoing treatment in hospital at Ongole, he has to look after her health.

2. The petitioner was convicted and sentenced to undergo imprisonment for life and to pay a fine of Rs.1,000/-, in default to undergo simple imprisonment for two months, for the offence punishable under Section 302 IPC.

3. The petitioner made similar request to enlarge him on bail on the ground of ill health of his grand mother and the same was negated by this Court in Crl.A.M.P.No.2082 of 2013 on 20.01.2014. Therefore, the second ground for grant of bail is not available now and the petitioner cannot be enlarged on bail at this stage.

4. The first ground for grant of bail is to attend the marriage of his sister and to look after the marriage arrangements, being the brother of the bride and he filed photostat copy of marriage invitation of Ms. Divyabharathi, scheduled to be performed on 14.08.2014.

5. Learned Public Prosecutor fairly conceded that the marriage is scheduled to be performed on 14.08.2014.

6. In the circumstance of the case, the presence of the petitioner at the time of marriage of his sister may be necessary. Therefore, recording the submission of the learned Public Prosecutor, the petitioner is enlarged on bail on his executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for the like sum each to the satisfaction of the Superintendent, District Jail, Nellore District, for a period of one week from the date of his release from the jail, and on completion of period of seven days, the petitioner is directed to surrender before the Superintendent, District Jail, Nellore District, who in turn, is directed to intimate the same to this Court.
