Heard the learned counsel for petitioner, learned Government Pleader

for first respondent and Sri Nimmagadda Venkatesarlu for second respondent.

2. This writ petition is filed questioning the action of the respondents in not paying the due amount of Rs.1,92,956/- to the petitioner towards civil work of construction of burning sheds in Kummari Street in Balaga in Ward No.2, Srikakularm entrusted to him vide Work Order Rc No. 3966/10/E1 dated 31.1.2011.

3. Petitioner claims to be a civil contractor and pursuant to tender notice dated 17.1.2011, being the lowest bidder, subject work was allotted to him vide order dated 31.1.2011 and petitioner successfully completed the subject work on 31.7.2011.

On completion of the work, petitioner has submitted relevant bills for Rs.2,74,244/-. Petitioner contends that after lot of persuasion part payment of Rs.95,000/- was made and balance amount of Rs.1,92,956/- is still due and payable to him and in spite of making number of representations, last being dated 2.6.2015 to respondents 1 and 2, no action is taken to release the due amount payable to him. Hence, the writ petition.

4. When the matter is taken up, learned counsel on either side agreed for disposal of the writ petition at the admission stage with a direction to the respondents to dispose of the representation of the petitioner expeditiously.

5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the respondents to consider the representation of the petitioner dated 2.6.2015 and pass appropriate orders as warranted under law within a period of four weeks from the date of receipt of copy of this order and communicate the decision to the petitioner. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
