The appellant herein fired E.I.c.No.61 0f 2020 under Section 75 (1) (s) c,f E.s.r. Act before the E.I.court seeking to set /

aside B5-B order dated 17.OB.2O2O for Rs.S, 11,9541- and to declare the appellant not liable to pay interest and damages to the respronclents-ESl Corporation. Vide impugnecl order, the E.l.Court dismissed the said petition with costs directing the appellanttopal'damagesatRs'5,11'9541-totherespondentscorporaticn. Aggrieved by the same' the present CMA is filed' 4.

The learned counsel for the respondents-corporation opposed- the appeal alleging that the ESIC New Amnesty Scheme 2o2]isapplicabletoCaSeSrn,hicharefiledbefore31.03.2025. 6.Inrellly,thellearnedcotrnselfortheappellantsubmitted that the E.I.rl.No.6 | or 2020 was initiated before the E'r'courr \mnestv scrrerne, 2o2511,2ss introduced' rt is furtYrer subrnit'ted intheyear2020andsaidCaServasPefldingwhenttr.eNew ./

_) that said scheme is applicable even to disputes involved in appeals.

As per Ner.r, Amnesty Scheme, 2025, a copy which is producecl b-v the appellant, said scheme is applicable to cases 'i'hich are filed up to 31.03.2025. That being the case, the E.I.c u'hich is filed in the year 2o2o is also covered under the scheme irrespective of the ract that the same was disposed of vide impugned order in the month of the July 2025. B.

In the result, the I.A.No.4 of 2O2S is allowed and the sposed of permitting the appellant to participate nesty Scheme, 2025. There shall be no order as eMA is also di rn ther Nelv..Arn ,., to costs.

Pending miscellaneous applications, if any, sfiqll stand closed.
