THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.38033 of 2016 ORDER :

This writ petition is filed to declare the action of the 3rd respondent in issuing letter No.5635/Tax/Cir.18/GHMC/16, dated 14.09.2016 insisting the petitioner to produce NOC from the concerned MRO be declared as arbitrary, illegal, violative of Articles 14, 19, 21, 300-A of the Constitution of India and contrary to the provisions of the GHMC Act and consequently direct the respondents 2 and 3 to release the building sanctioned plan without insisting the No Objection Certificate (NOC) from the concerned revenue authorities in respect of proposed construction of residential complex consisting of stilt for parking plus five upper floors in the property bearing Municipal No.10-3-20/5, 10-3-20/2, 10-3-20/5/3, 10-3-20/5/4, 10-3-20/5/5, 10-3-5/6, 10-3-20/5/7, 10-3-20/5/8, 10-3-27/5/8 (Old No.10-3-2/3/90) and 10-3-42/1A, situated at Addagutta Slum, East Marredpally, Secunderabad. 2.

When the matter is taken up, learned Standing Counsel produced letter No.5635/Tax/Cir.18/GHMC/2016 dated 08.11.2016 stating that the order dated 14.09.2016 which is assailed in the writ petition is withdrawn.

In view of the withdrawal of the proceedings under challenge the cause in the writ petition does not survive.

Writ Petition is accordingly closed. If the petitioner has any grievance, she is at liberty to avail appropriate legal remedies as available in law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
