HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5053 of 2013 ORDER:

When the matter is taken up for hearing, none appears for the petitioner and there is no representation on his behalf, though the matter is listed under the caption 'for dismissal'. Learned Standing counsel appearing for the respondents submits that as the petitioner has violated the terms of the Agreement, the allotment of land made in favour of the petitioner was cancelled and the same was resumed from the petitioner on 13.07.2012 and it was allotted to some third party on 15.01.2013 and this Court has granted status-quo order on 25.02.2013 i.e., after resumption of land from the petitioner and allotment of the same in favour of some third party.

In view of the above, this Court is of the considered view that the cause in the writ petition does not survive for adjudication and has become infructuous.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.
