HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SMT JUSTICE ANIS Writ Petition No.29051 of 2016 Order: (per V.Ramasubramanian, J.) Aggrieved by the refusal of the University to grant affiliation to their institution for the conduct of MBA course for the academic year 2016-17, the petitioners have come up with the above writ petition challenging not only the refusal to grant affiliation but also the Affiliation Procedure and Regulations, 2016 of JNTU.

2. Heard Mr. Tarun G. Reddy, learned counsel for the petitioners, Mr. A.Abhishek Reddy, learned counsel for the University and Mr. K.Ramakanth Reddy, learned counsel for AICTE.

Before taking up the contentious issues, it should be brought on record that by the impugned proceedings dated 01-7-2016, the petitioners-institution was granted affiliation for four under-graduate courses and one post-graduate course for the current academic year. But the University refused affiliation for two under-graduate courses in Technology, five post-graduate courses in Technology and MBA course. In the course of arguments, the learned counsel for the petitioners gave up their claim in respect of two undergraduate courses in Technology and five post-graduate courses in Technology in various disciplines. The refusal to grant affiliation in respect of MBA course alone was sought to

be assailed by the learned counsel, in the course of arguments.

4. As per the proceedings dated 01-7-2016, the petitioners had a shortage of two faculties for teaching MBA students. There were also no Ph.D., holders. But the learned counsel for the petitioners contended that the candidature of one Danturi Venkat Rao who holds a Ph.D., degree and the candidature of one Pochanna Kalthakayala who holds a M.Phil., degree in Economics was not considered.

5. But it appears from the certificates of educational qualifications presented by Danturi Venkat Rao that he passed a Master's Degree only in Commerce. Though he completed a MBA Degree in 2010, he had completed his Doctorate Degree only in Commerce in December, 2009. It means that he pursued MBA course even while he was a research scholar in the department of Commerce. Therefore, the non-consideration of his candidature was perfectly correct.

6. Similarly insofar as Dr. Pochanna is concerned, he holds a Master's Degree in Economics. Thereafter he has acquired the degree of M.Phil., in Econimics. Hence the Doctorate Degree obtained by him in Economics was not considered. This cannot also be found fault with especially since this candidate did not even hold a MBA Degree.

7. In view of the above, the non-consideration of the claim of the petitioners for affiliation for MBA course, is

perfectly in order. Hence the writ petition deserves to be dismissed.

8. We are not dealing with the challenge to the Affiliation Procedure and Regulations, 2016 of the University, since the challenge has now become only a matter of mere academic importance.

9. In the result, the writ petition is dismissed. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
