This Criminal Petition is filed under Section 482 Cr.P.C., is filed by the petitioner/A.4 to call for the records relating to Crime No.226 of 2018 of Mulug Police Station, Jayashankar-Bhupalpally, registered for the offence punishable under Section 420 IPC and Section 7 of the Essential Commodities Act, and quash the same. 2.

After arguing the matter for a while, learned counsel for the petitioner/A.4 requested the Court to issue a direction to the police concerned to follow the procedure under Section 41-A Cr.P.C and the guidelines issued by the Apex Court in the judgment reported in Arnesh Kumar v. State of Bihar and another1, while investigating the above crime.

Acceding to the request of learned counsel for the petitioner, the Criminal Petition is disposed of directing the Station House Officer, Mulug Police Station, Jayashankar-Bhupalpally District, to follow the procedure under Section 41-A Cr.P.C and the guidelines issued by the Apex Court in the judgment referred to above, before taking any coercive steps against the petitioner. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
