THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Public Interest Litigation No.89 of 2013 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) We have heard the learned counsel for the parties and we have considered the statements and averments made in the petition.
In this petition, the petitioner has alleged that there has been negligence and inaction in taking steps for covering the drains although, at some places, the covers of the open drains have either been damaged seriously, or removed. As a result of the same, they are posing threat of serious accidents. Under the circumstances, we direct appropriate Official of the Cantonment Board to make a visit of this entire stretch of the drain and wherever the covers of the drain are damaged or missing or destroyed, the same shall be replaced or repaired. This shall be done within a period of one month from the date of receipt of a copy of this order.
As far as the issue of payment of compensation for damages is concerned, the same can be claimed by the person individually and not by the petitioner in self styled representative committee.
With the aforesaid observations, the Public Interest Litigation is disposed of.
