HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.5831 OF 2018 ORDER:
The present Civil Revision Petition, under Article 227 of the Constitution of India, is filed by the petitioners - defendant Nos.2 and 3, questioning the inaction of learned VI Junior Civil Judge, City Civil Court, Hyderabad, in disposal of suit - O.S. No.870 of 2016.
2. The petitioners herein are defendant Nos.2 and 3 in the aforesaid suit, while respondent Nos.1 to 6 are the plaintiffs and respondent No.7 - GHMC is defendant No.1.
3. Learned counsel for the petitioner would submit that the petitioners despite reporting their readiness to proceed with the suit, the suit is not being taken up by the trial Court for one reason or the other and, therefore, requested to exercise power under Section 277 of the Constitution of India.
4. In view of the request made by the learned counsel for the petitioners, I deem it appropriate to direct the learned VI Junior Civil Judge, City Civil Court, Hyderabad to dispose of the suit - O.S. No.870 of 2016, pending on its file, in accordance with law, as expeditiously as possible, preferably within six (06) months from the date of receipt of a copy of the order.
3. Accordingly, the Civil Revision Petition is disposed of. No order as to costs.
MSM,J CRP No.5831 of 2018 Consequently, Miscellaneous Petitions, if any, pending in the present revision, stand closed.
