THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.14257 of 2016 ORDER:

The petitioner - accused - owner of the property filed this Criminal Petition under Section 482 Cr.P.C. praying to call for the records relating to Crime No.185 of 2016 on the file of the Police Station, Maripeda, Warangal District, including the order, dated 15-09-2016 in Crl.M.P.SR.No.3253 of 2016 in the Court of the I Additional Judicial First Class Magistrate, Thorrur, Wrangal District and quash the proceedings therein and order for release of 749 bags of rice each 25 kgs (Maharaja), 27 bags of rice each 25 kgs (Amulya), 47 bags of rice each 50 kgs (HDPE) 17 bags of rice each 50 kgs, seized under Crime No.185 of 2016 on the file of Police Station, Maripeda, Warangal District.

Heard the learned counsel for the Petitioner and the learned Public Prosecutor and perused the material available on record. Having regard to the facts and circumstances of the case, interim custody of 749 bags of rice each 25 kgs (Maharaja), 27 bags of rice each 25 kgs (Amulya), 47 bags of rice each 50 kgs (HDPE) 17 bags of rice each 50 kgs, seized under Crime No.185 of 2016 on the file of Police Station, Maripeda, Warangal District, shall be given to the petitioner on his executing a personal bond for Rs.1,00,000/- (Rupees One Lakh only) together with one surety for the like sum to the satisfaction of the Judicial First Class Magistrate, Thorrur, Warangal District. However, it is made clear that the present order will not stand in the way of confiscation proceedings,

if any, already passed. Further, this order does not preclude the authorities from passing any confiscation proceedings.
