2015-04-29Vilas V.Afzulpurkar3 pages

HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.11528 of 2015 ORDER:

Heard.

The petitioner complains that the 4th respondent is interfering with the civil dispute between the petitioner and the 5th respondent, which is subject matter of suit in O.S.No.27 of 2015 on the file of the Junior Civil Judge, Kanigiri and he is threatening the petitioner to withdraw the said case at the instance of the 5th respondent.

Learned Government Pleader for Home has received instructions from the 4th respondent, which specifically states that the 4th respondent never interfered with the civil dispute between the petitioner and the 5th respondent at any point of time and that the petitioner was never called to the police station as alleged by the petitioner. It is also stated that the complaint of the petitioner, dated 9-03-2015 was not received by the 4th respondent and that since the civil dispute between the petitioner and the 5th respondent is pending, the respondent police are nothing to do with the same.

In view of the said categorical statement that the 4th respondent is nothing to do with the civil dispute nor he interfered with the civil dispute between the petitioner and the 5th respondent, the same is recorded and no directions are called for. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 29-04-2015 Prv
