HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.3120 OF 2017 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to grant prearrest bail to the petitioners/A.2 and A.3 apprehending their arrest in connection with Crime No.22 of 2017 of Gachibowli Police Station, Cyberabad, registered for the offences punishable under Sections 498-A of the Indian Penal Code, 1860 (for short 'I.P.C.') and Sections 3 and 4 of Dowry Prohibition Act, 1961 (for short 'D.P.Act'). 2) The case of the prosecution is that the marriage of de facto complainant was performed with A.1 on 26.07.2015 and additional dowry was demanded at the time of marriage. Later, these petitioners along with A.1 subjected her to cruelty both physically and mentally for her failure to meet the additional dowry of Rs.5,00,000/- in cash and these facts fall within the definition of Cruelty in the explanation to 498-A I.P.C and further the offence punishable under Section 4 of D.P. Act.

3) As the investigation is in the midway at this stage, it is difficult to conclude that the petitioners/A.2 and A.3 committed no offences. Hence, I find no ground to enlarge the petitioners/ A.2 and A.3 on pre-arrest bail.

4) Accordingly, the Criminal Petition is dismissed. 5) Consequently, miscellaneous applications pending if any, shall also stand dismissed.
