SMT JUSTICE T. RAJANI CRIMINAL PETITION No.10519 of 2018 ORDER:

This Criminal Petition is filed under Section 438 Cr.P.C. seeking grant of anticipatory bail to the petitioners, who are A.2 and A.3 in Crime No.652 of 2018 on the file of Saroornagar Police Station, Rachakonda District, registered for the offences punishable under Sections 376 (2) (n), 342 and 506 read with 34 IPC and Section 4 of the POCSO Act, 2012.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The case of the petitioners is that the 1st petitioner introduced the victim girl to one Ravinder (A1) and that he asked the victim girl to love him, for which she refused. But, the 1st petitioner took her into a room, bolted the door from outside and Ravinder, who was inside the room, had sexual intercourse with her. The statement of the victim girl also shows that it is at the behest of the 2nd petitioner that the 1st petitioner closed the door. 4.

Considering the nature of allegations, it is considered as not a fit case to grant Anticipatory Bail to the petitioners. 5.

Accordingly, the Criminal Petition is dismissed, however the petitioners are at liberty to file a petition seeking regular bail before the Court concerned, in which event, the Court shall consider the petition on the same day subject to pressure of the other work. _____________ T.
