THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.40412 of 2015 ORDER:

The grievance of the petitioner is that the Joint Collector-II, Visakhapatnam Collectorate, Visakhapatnam District, issued notices dated 07.11.2015 and 13.11.2015 basing on the representation made by the local peoples representative and called upon its CEO to participate in an enquiry.

Sri K.Koteswara Rao, learned counsel for the petitioner, informed this Court that pursuant to the impugned notices the CEO of the petitioner did, in fact, appear before the concerned officer during the enquiry and was informed that his presence was no longer required.

The Joint Collector-II, Visakhapatnam, addressed written instructions dated 05.01.2016 to the office of the learned Government Pleader for Revenue, wherein he admitted that pursuant to the notices issued by him, the CEO of the petitioner attended the enquiry and deposed before him.

In the light of the aforestated developments, as the CEO of the petitioner has already responded to the impugned notices and has been informed that he has no role to play in the matter, no further adjudication is warranted.

The writ petition is accordingly closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
