This Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the action of the respondents in acquiring the petitioner's land to an extent of Ac.3-55 cents in survey No.415, situated at Baljipally Village, Peddamandadi Mandal, Wanaparthy District, as arbitrary and illegal.

Heard learned counsel for the petitioner and learned Government Pleader for Land Acquisition.

Earlier the petitioner herein approached this Court by filing W.P.No.24083 of 2016 and this Court dismissed the said Writ Petition with a liberty to the petitioner to approach appropriate Forum.

It is submitted by learned counsel for the petitioner that pursuant to the said order of this Court, the petitioner herein submitted an elaborate representation to the District Collector on 29.08.2016 for redressal of his grievance. It is further submitted by learned counsel for the petitioner that without taking any action on the said representation, now the respondent authorities are trying to take possession of the petitioner's property. It is further submitted that the earlier proceedings initiated under the Land Acquisition Act, 1894 have elapsed due to afflux of time and in view of the provisions of Section 24 of Act 30 of 2013. Since the representation filed by the petitioner is pending consideration
before the 1st respondent-District Collector, Wanaparthy, this Court deems it appropriate to direct the 1st respondent to look into the representation of the petitioner, dated 24.08.2016, verify and take appropriate action in accordance with law. 5.
Accordingly, the Writ Petition is disposed of with a direction to the 1st respondent to pass orders on the representation of the petitioner, dated 24.08.2016, within a period of two (02) months from the date of receipt of a copy of this Court. Till the said exercise attains finality, status quo with regard to possession of subject property shall be maintained by both the parties.
