THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.35439 OF 2014 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue for the respondents. The grievance of the petitioners is to the effect that though the petitioners have been granted house site pattas in the year 2003, the respective demarcation of the plots and handing over the possession has not been done till today.

Learned Government Pleader for Revenue had placed on record a letter, dated 20.11.2014, addressed by the Tahsildar, wherein it has been stated that the petitioners had been granted house site pattas and the demarcation has also been done by the then Mandal Surveyor. The Tahisldar's letter also speaks about a Circular, dated 23.01.2014, wherein it has been stated that possession certificate is not required.

A careful reading of the said letter does not disclose that the plots were demarcated and handed over the possession to the petitioners. Though learned Government Pleader for Revenue seeks time for filing counter, I am not inclined to adjourn the matter any further.

Considering the limited grievance of the petitioners and also the fact that the petitioners were admittedly granted pattas, the benefit of the same can be enjoyed by the petitioners only when the house site pattas were clearly demarcated and were put in possession to enable them to construct their houses.

In that view of the matter, the Writ Petition is allowed directing respondents 1 to 3 to take necessary steps for clear demarcation and handing over the possession of the house sites, which have been

allocated to the petitioners. This exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

The miscellaneous petitions filed in the Writ Petition shall also stand disposed of.
