HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.13879 of 2015 O R D E R :

This criminal petition is filed by petitioner - accused No.3, under sections 437 and 439 Cr.P.C., seeking bail pending trial in S.C.No.97 of 2010 on the file of the Court of the Mahila Sessions Judge, Vijayawada (F.I.R. No.56 of 2010 on the file of S.N.Puram Police Station, Vijayawada, Krishna District), for the offences under Sections 302, 384, 201, 120-B read with Section 34 I.P.C.

The earlier bail petitions filed by the petitioner - accused No.3 were dismissed by this Court. So far 78 witnesses were examined in the case and now the case is posted for examination of 79th witness.

Considering the aforesaid facts it is not proper to grant bail at this stage. If the bail is granted to the petitioner-accused No.3, it will certainly cause prejudice to the trial before the concerned Court.

Hence, the Criminal Petition is dismissed. In any event, the trial Court is directed to dispose of the case as expeditiously as possible more preferably within six months from today. ______________________ JUSTICE RAJA ELANGO 04th January, 2016
