HON'BLE SRI JUSTICE S.V.BHATT W.P.No.31000 OF 2012 ORDER:

The petitioner challenges the unilateral cancellation of Gift Deed dated 15.09.2009 through Cancellation Deed No.6134/2012 dated 05.09.2012, as illegal and contrary to the provisions of the Registration Act and the Rules framed thereunder.

Counsel appearing for the parties fairly state that the grievance of petitioner is squarely covered by the decisions of the Apex Court and this Court in Thota Ganga Laxmi v. Government of Andhra Pradesh[1] and Garagaboyina Radhakrishna v. the District Registrar[2]. I have perused the Revocation Deed No.6134/2012. Prima facie, it appears the 5th respondent unilaterally revoked the Gift Deed dated 15.09.2009. Having regard to the principles laid down in the decisions referred to above, the unilateral cancellation is illegal. The writ petition is ordered by setting aside the Revocation Deed No.6134/2012. No order as to costs.
