THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4695 of 2015 ORDER:

Alleging inaction on the part of respondents 3 and 4 in allotting land to her, she filed this writ petition.

2. The petitioner, purportedly belonging to Scheduled Tribe community, constructed a dwelling with asbestos sheet in Ac.0-85 cents in Survey No.35/2B of Kanta Bhansuguda village, Araku Valley Mandal, Visakhapatnam district, which is admittedly a Government land, and has been in possession and enjoyment of the same for over 15 years now. She states that she submitted a representation to the 4th respondent-Tahsildar on 16.09.2014 requesting to allot the land in her occupation considering her eligibility as a person belonging to Scheduled Tribe. Consequent to her representation, the Mandal Revenue Inspector enquired and submitted a report to the 4th respondent, but no action was taken. The petitioner submitted another representation on 12.01.2015 to the 3rd respondent. The 3rd respondent directed the 4th respondent to enquire and submit a report, but no action is taken by the 4th respondent till date. Hence, the writ petition.

3. Heard the learned counsel for both the parties and perused the record.

In view of the submissions made by both the counsel, this Court is of the view that the writ petition can be disposed of with a direction to the respondent authorities to consider the representations dated 16.09.2014 and 12.01.2015 and pass appropriate orders thereon, in accordance with law, after examining her eligibility for grant of house site. The entire exercise shall be completed within four months from the date of receipt of a copy of this order.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
