HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.8296 of 2013 ORDER:

Heard Sri N. Krishna Sumanth, for petitioner and the Assistant Government Pleader for Home-respondents.

2. The petitioner prays for mandamus declaring the action of the respondent-authorities in continuing Look-Out-Circular against the petitioner, in spite of all criminal cases filed against him are terminated, as illegal and unconstitutional.

3. The counsel contends that very issuing of Look out Circular is illegal and contrary to Circular instructions issued by the Ministry of External affairs. He prays for setting aside the Look out circular.

4. The Assistant Government Pleader by reference to the written instructions dated 12.02.2013, submits that the 3rd respondent through communication No.C.No.2108/ C22/ IP/ CID/ 2010, dated 12.02.2013, requested the Immigration Department to cancel the look out circular. Therefore, the writ prayer is untenable. The communication dated 12.02.2013 reads as follows:

" It is to inform that the LOC was initiated against the accused Akinapalli Chandra Sekhar wanted in Cr.No.11/ 20010 U/ s 498(A), 494, 495, 420 and 506 IPC of CID PS, Hyderabad. In the above case, both the parties have compromised outside the court and approached the High Court and filed a petition and the case was quashed by the High Court. It is therefore requested to cancel the LOC against the accused Akinapalli Chandra Sekhar and intimate to this office at the earlier."

5. The same is placed on record.

6. The writ petition is, accordingly, disposed of. If the petitioner still has a grievance in continuing the look out circular in spite of request dated 12.02.2013, the petitioner is given liberty to workout remedies in accordance with law. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
