The present writ petition is filed by the petitioners seeking to quash the proceedings against the petitioners in FIR No.490 of 2016 on the file of the 3rd respondent.

Heard and perused the material available on record. 3.

It is stated in the affidavit that the 1st petitioner is the owner of Vasant Motors dealing in selling of second hand vehicles and the 2nd petitioner is the incharge. The 4th respondent's brother met with an accident while driving the vehicle of the 4th respondent. The brother of the 4th respondent took the vehicle to the shop of the petitioners. The petitioners repaired it and claimed Rs.3,64,308/- towards charges. The 4th respondent paid Rs.1,00,000/- and took the vehicle to keep it in her premises and informed the 1st petitioner to sell the vehicle and then, she will adjust the balance amount. But she changed her version subsequently. Therefore, differences arose between the petitioners and the 4th respondent. Due to such differences, she lodged a false complaint against the petitioners.

Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, respondents No.2 & 3 are directed to complete the investigation and file a final report, in accordance with law, without arresting the petitioners. 5.
