THE HONOURABLE SRI JUSTICE RAJA ELANGO Crl.P.M.P.Nos.1268 & 1269 of 2016 IN/AND Crl.P.No.1339 OF 2016 COMMON ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioners/A-1 to A-4 seeking to quash the proceedings in C.C.No.392 of 2015 on the file of the XV Additional Chief Metropolitan Magistrate, Hyderabad.

2. Heard and perused the material on record.

3. The petitioners are facing trial for the offences punishable under Sections 498-A, 506 and 406 I.P.C. and Sections 4 and 6 of the Dowry Prohibition Act, 1961.

During the pendency of the petition, the petitioners and respondent No.2/de facto complainant, who is the wife of petitioner No.1, filed Crl.P.M.P.Nos.1268 and 1269 of 2016 to permit them to compromise the matter by recording the compromise entered into between them. They also filed a joint memo for compromising the issue. The said compromise memo reads as follows: "It is humbly submitted that the petitioners and respondent No.2 have compromised the matter out of the Court with the intervention of elders and well wishers and in view of the compromise, they do not want to further proceed with the case against the petitioners/Accused Nos.1 to 4 in C.C.No.392 of 2015 on the file of Hon'ble XV Addl. Chief Metropolitan Magistrate, Hyderabad, as such the same may be quashed against the petitioners/Accused Nos.1 to 4 in the interest of justice."

4. Both parties are present and they are identified by their respective counsel. In view of the compromise entered into between the parties and as the offences arise out of matrimonial

disputes, the petitioners are permitted to compromise the matter.

Accordingly, Crl.M.P.Nos.1268 and 1269 of 2016 are ordered and the Criminal Petition is allowed quashing the proceedings in C.C.No.392 of 2015 on the file of the XV Additional Chief Metropolitan Magistrate, Hyderabad. However, the petitioners as well as respondent No.2 shall deposit a sum of Rs.5,000/- (Rupees five thousand only) towards Telangana State Legal Services Authority, Hyderabad towards costs and the Registry is directed to issue copy on production of receipt of the same.

6. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
