Heard learned counsel for the petitioner, Learned Government pleaders for Panchayat Raj & Revenue and learned Standing counsel for Gram Panchayat.

This writ petition is filed alleging that the Gram Panchayat is taking steps to construct earthworms' tank in public punta situated on the northern side of the petitioner's property in Sy.No.326/2 of Duppalapudi Village, Anaparthy Mandal, East Godavari District.

Learned counsel for the petitioner sought to contend that the said construction would affect the petitioner in enjoying his property. There is also a vague reference in paragraph No.2 of the affidavit filed in support of the writ petition that the said punta is used for public purpose and such construction would affect ingress and aggress to petitioner's property. 4.
According to learned Standing counsel earlier there were public toilets in existence for more than 30 years. The Gram Panchayat passed resolution on 03.02.2018 to demolish the public toilets and to construct Solid Waste Management Plant in an extent of Ac.0.06 cents in Sy.No.327/2. If petitioner is aggrieved by the resolution of Gram Panchayat, he should avail appropriate remedies as available in law.

At this stage, learned counsel for the petitioner seeks leave of the Court to make a representation with reference to affecting of ingress and aggress to the property of petitioner.

Having regard to the above submission, the Writ Petition is disposed of granting the liberty to the petitioner to make a representation or to avail appropriate remedies as available in law against the resolution passed by the Gram Panchayat.
