THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8687 of 2015 ORDER:

This criminal petition is filed by the petitioner-Accused No.1, under section 438 of the Code of Criminal Procedure, seeking grant of anticipatory bail in Crime No.131 of 2015 on the file of Nellore Rural Police Station, Nellore District, registered for the offences punishable under Sections 420, 464, 468 and 471 read with 34 IPC. Heard and perused the material available on record. The allegation against the petitioner is that he created forged documents with the help of A2 and A3 and sold the property of the de facto complainant to a third person by forging the signatures of the de facto complainant. Learned counsel for the petitioner submitted that the said plot belongs to petitioner and he is a bonafide purchaser and he purchased the same in the year 2014 and sold it under registered document to one K. Vijayalakshmi. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

The petitioner - A1 is directed to surrender before the Station House Officer, Nellore Rural Police Station, Nellore District, and on such surrender he shall be released on bail on his execution of a bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum. The police concerned are directed to take signatures and handwriting of the petitioner for the purpose of investigation. The petitioner is further directed to appear before the police concerned, on every day between 10.00 a.m. and 5.00 p.m., until further orders.
