The grievance of the petitioner in this case was that the police authorities were not conducting investigation in Crime No.60 of 2011 on the file of the Eluru III Town Police Station, West Godavari District, and a consequential direction was sought to them to conduct the investigation and file a charge sheet before the competent court.
The Probationary Deputy Superintendent of Police-cum-In charge Station House Officer, III Town Police Station, Eluru, West Godavari District, filed a counteraffidavit stating that upon the petitioner's complaint dated 04.04.2011, Crime No.60 of 2011 had been registered under Sections 324, 394 and 506 I.P.C. read with
Section 149 I.P.C. on the file of the Eluru III Town Police Station and investigation was taken up. He further stated that a prima facie case was found to have been made out against accused Nos.1 to 3 but, as no case was made out against accused Nos.4 and 5, their names were deleted. He further stated that a charge sheet under Section 173 Cr.P.C. would be filed against accused Nos.1 to 3 expeditiously by following the due procedure. This counter-affidavit was filed on 20.07.2011. In the light thereof, it is clear that the petitioner's grievance stands settled and no further consideration is required in this writ petition.
The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
