Sri C. Pandu Ranga Rao v. The State Of Telangana, Represented By Its Principal
HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43930 of 2016 ORDER:
This writ petition is filed seeking to declare the action of the respondent police in registering the FIR No.505 of 2016, dated 19.11.2016, as illegal and arbitrary and consequently quash the proceedings in FIR No.505 of 2016.
Heard and perused the material available on record. The case of the petitioners is that the 4th respondent lodged the present complaint against the petitioners alleging that the petitioners threatened the 4th respondent with dire consequences by using un-parliament language and breached the MOU with common intention. The main grievance of the petitioners is that basing on the said complaint, the 3rd respondent is harassing the petitioners on one pretext or the other.
Learned counsel for the petitioners submitted that there is a civil dispute pending between the petitioners and the 4th respondent with regard to the alleged agreement of sale, dated 22.08.2013, prepared by the husband of the 4th respondent and filed a civil suit in O.S.No.718 of 2016, on the file of XVI Additional District Judge, Ranga Reddy District, at Malkajgiri, and that the suit is pending for adjudication.
Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.505 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. The petitioners are directed to execute personal bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one
surety for the like sum each to the satisfaction of the 3rd respondent as surety for their future appearance for the purpose of investigation.
With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
