HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.17269 OF 2016 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader.

2. The grievance of the petitioners is that their possession and enjoyment over the agricultural lands in Survey Nos.47/1, 47/2 and 47/3 of Rachakonda Revenue Village, Pullalacheruvu Mandal of Prakasam District, is sought to be interfered with by the respondents without issuing any notice, without acquiring the lands, and without payment of any compensation to the petitioners.

3. Learned Government Pleader submits that the allegations made by the petitioners are false. If really the petitioners are to be evicted, the respondents-authorities would follow the due process of law and appropriate steps would be taken in accordance with law.

4. In that view of the matter, it is made clear that no work shall be undertaken by the officials of the respondents Survey Nos.47/1, 47/2 and 47/3 of Rachakonda Revenue Village, Pullalacheruvu Mandal of Prakasam District, without putting the petitioners on notice and without acquiring the lands by paying the due compensation.

5. Accordingly, the Writ Petition is disposed of directing the respondents not to undertake any works in Survey Nos.47/1, 47/2 and 47/3 of Rachakonda Revenue Village, Pullalacheruvu Mandal of Prakasam District, without putting the petitioners on notice and

without acquiring the lands by paying the due compensation. In view of the disposal of the main writ petition, Miscellaneous Petitions, if any pending in this writ petition shall also stand closed. No order as to costs.
