HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.11834 OF 2015 ORDER:

It is the case of the petitioners that one late Gosetti Rajulu is husband of the 1st Petitioner and father of 2nd and 3rd petitioners. The husband of the 1st petitioner was granted assignment D.K. Patta for an extent of Ac.4-00 cents and Ac.0-88 cents situated in Sy.Nos.357/2 and 375/2 of Kapulappada Village, Bheemunipatnam Mandal, Visakhapatnam District, by the then Tahsildar, Bheemunipatnam Mandal, under Ex-Servicemen quota through proceedings in DR.No.237/1402, dated 29.11.1992. It is further submitted that the petitioners have been in possession and enjoyment of the subject lands since the death of said Rajulu on 02.11.2009 and eking out their livelihood by cultivating the said lands. It is the grievance of the petitioners that the 4th respondent-Tahsildar has issued an order dated 07.01.2008 in Rc.No.

139/2005/ARI cancelling the patta granted in favour of late Rajulu stating that the assignment patta was not genuine one and directed the Mandal Revenue Inspector, Bheemuniptnam to take possession over the aforesaid lands. Questioning the said order, petitioners filed Appeal in Rc.No.1613/2008/A before the 3rd respondent-Revenue Divisional Officer, Visakhapatnam, which also came to be dismissed on 27.12.2008. As against which the 1st petitioner's husband viz., late Rajulu filed revision before the Joint Collector under the provisions of Paragraph 18 of BSO 15 of Board of Revenue Standing Orders in the month of March, 2009, but on 02.11.2009 the husband f the 1st petitioner died and the legal representative petition also filed before the Joint Collector on 05.03.2015.

The revision is of the year 2009 and the 1st petitioner is aged about 67 years, she prays for a direction to the 2nd respondent-District Collector, Visakhapatnam, to dispose of the revision expeditiously. Considering the relief sought by the petitioners and considering the fact that on earlier occasion when the said Rajulu approached this Court by filing W.P.No.

to dispose of the appeal filed by the husband of the 1st petitioner, there shall be a direction to the respondent authorities to dispose of the revision in accordance with law within a period of 12 weeks.

With the above direction, this Writ Petition is disposed of at the admission stage. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
