THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 41266 OF 2016 O R D E R :
This Writ Petition has been filed to quash the proceedings in S.C. No. 32 of 2016 on the file of the Court of the I Additional District & Sessions Judge at Srikakulam insofar as the petitioner, who has been arrayed as Accused No.2, is concerned. It is unnecessary for this Court to refer to any of the facts, for, no Writ Petition questioning the filing of the charge sheet is maintainable. However, as the petitioner prays for issuance of any other appropriate Writ, this Court is of the opinion that the Writ Petition can be disposed of giving liberty to the petitioner to approach the appropriate Court. As the petitioner apprehends arrest on account of the non-bailable warrant issued by the Court of the I Additional District & Sessions Judge, Srikakulam, he is at liberty to seek recall of the warrant by filing an appropriate Application before the said Court. As and when such an Application is filed, the same shall be considered and disposed of on the same day, subject to the conditions that may be imposed by the said Court.
With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
