ORAL ORDER:
Petitioner alleges illegal and unauthorized construction by third respondent.
On instructions, learned standing counsel for municipalities submits that no building permission is granted and as verified by the staff of the municipality, no construction activity is going on in the subject premises. If that is so, the contention of the learned counsel for petitioner that illegal and unauthorized construction is going on is baseless. Petitioner has not filed any material to disprove the statement of the learned standing counsel on instruction furnished by the municipal authorities. No complaint is filed by the petitioner and straightaway this writ petition is filed.
This writ petition is liable to be dismissed and accordingly dismissed. However, if petitioner has any information regarding the alleged illegal construction taken up by third respondent, it is open to the petitioner to file a complaint before the Commissioner of Municipality/second respondent and on filing such a complaint, the Commissioner shall consider and take appropriate decision as warranted by law. No costs.
