THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.29380 OF 2015 ORDER:

Heard.

The petitioner states that he is a resident of Kondapalli Village, Ibrahimpatnam Mandal, Krishna District, which is now a part of capital region development authority's jurisdiction.

He contends that his father obtained Layout No.59/81 to an extent of Ac.11.00 of land in R.S.No.444/2 of Kondapalli Village, Ibrahimpatnam Mandal, Krishna District. Out of the said extent, an extent of Ac.0.50 cents of land is earmarked as open space for community purpose and the remaining land was divided into house plots, which were sold to various persons. Alleging that the open space accommodated for public purpose is being used for taking up constructions contrary to the layout, the petitioner made a representation, dated 16.07.2015, to respondents 2 to 5 followed by another representation, dated 31.07.2015, to the 5th respondent requesting them to safeguard the open space in the layout. Alleging inaction on the part of the respondents, the present Writ Petition is filed.

The petitioner's representations are stated to be pending with the 2nd and the 5th respondents respectively, as stated above. In view of the same, it is appropriate to dispose of the Writ Petition by directing the 2nd and 5th respondents respectively, to look into the petitioner's representations and take appropriate action in accordance with law, expeditiously.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
