.....Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents in considering petitioners representations dt.13.03.2015, 02.12.2014, 16.12.2014 and 20.12.2011 as illegal, arbitrary and consequently direct the respondents 1 to 3 to forthwith restrain the respondents 4 and 5 from proceeding with illegal blasting of stones in land to an extent of 1 Hectare situated in Sy.No.259/1A of Rolugunta Village and Mandal, Visakhapatnam District. The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri S. Sridhar, Advocate for the Petitioners, G.P. for Mines & Geology (AP) for Respondent Nos.1 & 2, G.P. for Home (AP) for Respondent No.3, and Sri M. Sivananda Kumar, Advocate for Respondent Nos.4 & 5, the Court made the following ORDER:
R4 and R5 are now represented by Sri M. Sivananda Kumar, who seeks time to file counter.
The instructions of the learned Govt. Pleader do not speak of illegal blasting of stones as alleged by the petitioners. Hence, R2 and R3 are directed to inspect the quarry site and ensure that no illegal blasting as alleged by the petitioners is allowed by lessee. List after Summer Vacation, 2015.
Meanwhile, R2 and R3 to file report after inspection. R4 and R5 to file counter affidavit.
