THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41662 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in registering crime No.637 of 2016 against the petitioner on a complaint given by the 4th respondent, as illegal and arbitrary and consequently, quash the same.

Heard and perused the material available on record. The 4th respondent lodged a complaint before the 3rd respondent stating that his daughter went for slimming classes on 11.11.2016 and thereafter, she did not return home, and after sometime, she make a phone call and told that she has gone and will return after 8 to 10 days. He suspects that his daughter might have gone along with the 1st petitioner. Basing on the said complaint the 3rd respondent registered the above case as Woman Missing.

It is stated by the petitioners that that 2nd petitioner has already made a representation to the 3rd respondent on 11.11.2016 informing that she got married the 1st petitioner on 11.11.2016 in the Arya Samaj, Hyderabad, against the will of her parents and her parents are threatening her and her husband with dire consequences, and therefore, she requested to take action against her parents. She also made another representation before the 2nd respondent on 18.11.2016 stating that though she intimated about her marriage to her parents, her father lodged a complaint before the 3rd respondent and the same was registered as Crime No.637 of 2016 for 'Woman Missing' and the 3rd respondent took up investigation in that crime, and even after

knowing that the both the petitioners got married, the 3rd respondent is continuously harassing the 1st petitioner at the instance of the 4th respondent, but the 2nd respondent is also not taking any action on the representation made by the 2nd petitioner. Considering the grievance of the petitioners, without going into the merits of the case, the 3rd respondent is directed not call the petitioners to the police station and not to harass them in the name of investigation.

Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J December 01, 2016.
