This Company Petition is filed for winding up of the respondent Company for non-payment of the debt due to the petitioner.

Learned counsel for both the parties submit that the respondent Company is pursuing the proceedings before the National Company Law Tribunal and the petitioner has also made its claim before the Resolution Professional and pray for closing of the Company Petition with liberty to the petitioner to work out the remedies under the Insolvency and Bankruptcy Code. In those circumstances, the Company Petition is closed, leaving it open to the petitioner to work out the remedies under the Insolvency and Bankruptcy Code.
