THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION NO.11024 of 2016 ORDER :
The petitioner, who is A4 in Crime No.183 of 2016 of Piduguralla Police Station, Guntur District, filed the present application under Section 438 Cr.P.C., seeking release in the event of his arrest in connection with the above crime registered for the offences punishable under Sections 417, 354A, 354C of IPC and Sections 66E, 67A of IT Act 2000-2008 and Section 3(i)(e) & W (i) of SCs and STs (POA) Act, 2015.
The case of the prosecution is that on 11.06.2016, a report came to be lodged by the informant, who belongs to Scheduled Tribe, stating that when she approached the accused, they lured her stating that she was selected for short film, shot some stills with accused, administered some liquor lace with cool drink, stripped off her clothes, applied oil over her body and shot video through cell phone without the knowledge of victim. On coming to know about the same, the informant asked the accused to return the photos and to delete the videos, but A2 insisted her to participate in sexual intercourse with him. Later the accused are alleged to have gone to the house of informant and exhibited the said videos and photos to her parents and relatives. Basing on these allegations, the present case came to be registered.
A perusal of the remand report mainly establishes the role of the petitioner in trying to cheat the informant. The statement of the informant clearly discloses that victim was forced to sit in the lap of the petitioner, though she opposed for the same. Thereafter, the accused indulged in vulgar acts in outraging her modesty. Having regard to the above and since the allegations made are
grave and serious in nature, I am not inclined to grant anticipatory bail to the petitioner.
