THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.36451 of 2018 ORDER:
When the matter is taken up, written instructions dated 08.10.2018 furnished by the Sub-Inspector of Police, Kamepally Police Station, Khammam District are placed on record by the learned Government Pleader for Home.
To the extent of their relevance to the present writ petition, the said instructions read as under:
"The petitioner herein has approached the Police of Kamepally Police Station of Khammam District on 18.6.2017 with the complaint of 15.6.2017 and requesting to initiate action against B.Murali as he came to her regartding land dispute and abused her in filthy language..
Upon receipt of the said petition, after enquiry into the matter, then and there, a petty case vide Consecutive No.207/2017 dated 18.6.2017 U/sec.294 (b) IPC against the Mr.B.Murali and after completion of investigation, petty case charge sheet was also filed against him before the Hon'ble Court of Second Class Magistrate at Yellandu and the same was taken on the file vide STC.No.847/2017. The accused/4th respondent B.Murali admitted his guilt and the Hon'ble Court imposed a fine amount of Rs.300/- on 29.6.2017.
It is pertinent to submit that the petition of the petitioner herein was considered by this respondent by way of Registration of Petty Case against Mr.B.Murali/4th respondent U/sec.294 (b) IPC on 18.6.2017 and after filing of the charge sheet against him before the concerned Hon'ble Court, the dame was taken on file vide STCNo.847/2017 and the accused admitted his guilt and the Hon'ble Court imposed fine amount of Rs.300/- on 29.7.2017.
It is submitted that except the above no other complaint whatsoever was received from the petitioner herein in this respondent police station as of now.
A copy of the Petty Case Register dt.18.6.2017 is annexed to this written instructions for the kind perusal of this Hon'ble Court."
On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.
Accordingly, the writ petition is disposed of by placing on record the written instructions dated 08.10.2018 furnished by the Sub-Inspector of Police, Kamepally Police Station, Khammam District. There shall be no order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
