ORDER:
This writ petition is filed for a mandamus to declare the action of respondent No.2 in not appointing the petitioner as fair price shop dealer of Narsaipally Village, Koderu Mandal, Mahabubnagar District, in pursuance of notification No.J/1363/10, dated 14.08.2010, as illegal and arbitrary.
At the hearing, Mr.D.L.Pandu, learned counsel for the petitioner, submitted that during the pendency of this writ petition, respondent No.2 has appointed respondent No.4 as permanent fair price shop dealer. In view of the above subsequent event, the writ petition as conceived does not survive for adjudication. The petitioner is, however, entitled to avail appropriate remedy, if he feels aggrieved by the appointment of respondent No.4 by raising all
legally permissible grounds including those raised in the present writ petition. Subject to the liberty given to the petitioner as above, the Writ Petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.12655 of 2011 filed by the petitioner for interim relief shall stand disposed of as infructuous. __________________________ C.V.NAGARJUNA REDDY, J 03rd June, 2015 GHN
