THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.60 of 2015 ORDER:

Heard both sides.

The case of the petitioners is that the 3rd respondent initiated proceedings against them alleging transfer of their property in contravention of Section 3(1) of the A.P.Scheduled Area Land Transfer Regulation, 1959, read with amended Regulation, 1970 and passed ejection order dated 20.02.2012. Against the same, the petitioners preferred appeal before the 2nd respondent and the same was also dismissed by the 3rd respondent by order dated 26.09.2014 and the petitioners have received the said order in the month of October, 2014 and immediately filed a revision before the 1st respondent on 09.12.2014 along with stay petition. Though, the revision is pending, the 4th respondent came to the spot and started measuring land stating that the subject land will be allotted to the third parties. Hence, the present writ petition is filed.

Since it is stated that statutory revision is pending before the 1st respondent against the eviction orders passed by the 3rd respondent, I deem it appropriate to direct the 1st respondent to dispose of the revision filed by the petitioners. Till the revision is disposed of, the impugned order dated 28.02.2012, which was confirmed in appeal No.4/LTR/508/2012 dated 26.09.2014 is stayed and respondents are directed not to assign the lands of petitioners to an extent of Ac.14-03 gts. in Sy.No.25 situated at Bazarhathnoor village and Mandal, Adilabad District to any third party.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to it, miscellaneous petitions, if any pending in this writ petition, shall stand closed.
