The very prayer in the writ petition is to quash the notice issued by 3rd respondent/ Tahsildar, dated 28.08.2018 seeking appearance on 04.09.2018 at 11.00 a.m. allegedly served on the night of 04.09.2018, that notice appears ceased, as it is served before the trial, thereby, there is nothing to quash much less to call for the record for that purpose, as the very petition averments are clear in this regard. Thus, if at all to impugn, remedy is left open by giving with a proper prayer if not filed any objection/ counter before the Executive Magistrate as contemplated by Sections 145 to 148 Cr.P.C.
