ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/respondents 5 & 6 seeking to quash the proceedings in DVC No.8 of 2016 on the file of Judicial First Class Magistrate, Bhimadole, West Godavari District, against them. 2.
Heard learned counsel for petitioners/respondents 5 & 6 and learned Additional Public Prosecutor representing the State.
3. It is alleged in the complaint that the second respondent married the first respondent on 02.12.2015 at Duddukuru Village and from the date of marriage, he suspected her fidelity and used to harass her mentally and physically by demanding additional dowry at the instigation of other respondents and he had illicit intimacy with a nurse, thereby subjected her to domestic violence.
4. Learned counsel for petitioners argued that the petitioners are innocent and they have not committed any offence.
5. Having regard to the facts and circumstances of the case and in view of the nature of offence, this Court is satisfied that the presence of petitioners/respondents 5 and 6 can be dispensed with.
6. In the result, the Criminal Petition is disposed of dispensing with the personal appearance of petitioners/respondents 5 and 6 in DVC No.8 of 2016 on the file of Judicial First Class Magistrate,
ANIS,J Crl.P.14119 of 2016 Bhimadole, West Godavari District. However, they shall appear before the trial Court as and when directed by the trial Court. Miscellaneous applications, if any, pending in this criminal petition shall stand closed.
