HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 5 7 8 3 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Agiripalli P.S., Krishna District, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that one Tirumala Venkata Srinivas came to Police Station and submitted a complaint along with material papers stating that he is having land in Sy.No.43/ 1 & 2 to an extent of Ac.2.00 cents which is under the possession and enjoyment of the said complainant. The writ petitioner removed the boundary stones and fencing with an intent to occupy the property of the said complaint. In this regard a civil suit No.222/ 2009 is pending before the II-Additional District Munsif Court, Nuzvid. Basing on the complaint, the SubInspector of Police, Agiripalli Mandal, Krishna District made GD entry and called the writ petitioner to the Police Station and advised both the parties to maintain law and order in the village.
It is submitted that the Station House Officer, Agiripalli, did not involve in the Civil dispute in any manner and basing on the complaint made by T.Venkata Srinivas, the Station House Officer, called the writ petitioner and advised to settle the matter in the civil Court."
Having regard to the contents of the above instructions, this Court deems it appropriate to dispose of the Writ Petition, by placing on record the said instructions, with a direction to the respondent-authorities not to meddle with the civil disputes,
unless there is an Order of the civil Court in this regard. It is also made clear that if any law and order issue arises, it is open for the police to take action in accordance with law.
