This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue Writ Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of respondent No.2 in interfering with the civil dispute pending between the petitioners and the 3rd respondent and coercing the petitioners to settle the dispute with the 3rd respondent under threat of arrest is arbitrary and illegal and unconstitutional and consequently direct the 2nd respondent not to interfere with the civil dispute between the petitioners and the 3rd respondent."
Heard Sri K.Someswara Kumar, learned counsel for petitioners, learned Government Pleader for Home for respondents 1 and 2 and Sri V. Venu Gopal Rao, learned counsel for respondent No. 3.
When the matter is called, learned Government Pleader for Home has placed on record the written instructions dated 03.06.2015 furnished by the Sub Inspector of Police, Bhavanipuram Police Station, Vijayawada City. It is stated in the said instructions that the 3rd respondent lodged a private complaint under Section 200 of the Code of Criminal Procedure before the Chief Metropolitan Magistrate, Vijayawada against the petitioners and on receipt of the said complaint, the Station House Officer, Bhavanipuram Police Station, Vijayawada registered a case in Crime No.683 of 2014 dated 31.12.2014 under Sections 420, 423, 506, 120-B read with 34 IPC and Section 156 (3) Cr.P.C. It is further stated that during the course of investigation the complainant and two other witnesses have been examined and their statements have been recorded and
final report will be submitted before the concerned Court after completion of investigation. The said instructions further deny that the petitioners herein were called to the police station and were threatened to settle the dispute with the 3rd respondent. It is also stated that only to divert the investigating agency and to escape from the criminal liability the petitioners herein filed the present writ petition with baseless allegations.
On noticing the said instructions, learned counsel for the petitioners has made a request to record the said instructions. In view of the above, the writ petition is closed recording the instructions, dated 03.06.2015, submitted by the Sub-Inspector of Police, Bhavanipuram Police Station, Vijayawada City. There shall be no order as to costs. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence.
