HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1823 of 2015 ORDER:
This revision is preferred challenging the order dated 19-08-2015 made in Crl.M.P.No.4599 of 2015 in C.C.No.341 of 2013 by the Judicial Magistrate of First Class, Special Mobile Court, Guntur, wherein the learned Magistrate dismissed the petition filed by petitioners invoking the provisions under Section 70 (2) of Cr.P.C. to recall N.B.Ws. issued against petitioners - accused Nos.1 and 2.
The learned counsel for petitioners submitted before this Court that petitioners are ready to face the trial and they will not flee from the hands of justice. Having heard the learned counsel for petitioners and the learned Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions :
The petitioners/accused Nos.1 and 2 are directed to surrender before the Court concerned and file a petition to recall the warrants issued against them and on such filing of a petition, the trial Court is directed to recall the warrants on the same day on their execution of bond for a sum of Rs.10,000/- (Rupees Ten thousand only) each with one surety for a like sum each and further the petitioners are directed to appear before the trial Court regularly. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
