HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Petition No.35879 of 2018 ORDER: {Per Hon'ble Sri Justice Ramesh Ranganathan} The proceedings under challenge in this writ petition is the order passed by the Chief Metropolitan Magistrate, Cyberabad, Ranga Reddy District in Crl.M.P.No.641 of 2018 for execution of the warrant dated 07.10.2018.

While fairly stating that the petitioners had defaulted in repayment of the loan amount, Sri D.V.Ramana Sarma, learned counsel for the petitioners, would complain of the 2nd petitioner's ill-health being the ground for non-payment of the instalments; and would submit that the petitioners are ready and willing to repay the entire debt in two equal monthly instalments.

It would be wholly inappropriate for us to either undertake the exercise of re-scheduling the debt due by the petitioners to respondents 1 and 2 or to direct the latter to recover the amount in instalments. Suffice it, therefore, to direct that, in case the petitioners have any grievance in this regard, it is always open to them to make an application to respondents 1 and 2. It is also open to respondents 1 and 2 to examine the same without being influenced by any observations made in this order.

Subject to the above observations, the Writ Petition fails and is, accordingly, dismissed. Miscellaneous petitions pending, if any, shall stand closed.
