THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4977 OF 2016 ORDER:
This petition is filed by the petitioner-accused No.4 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.167 of 2014 on the file of the Additional Junior Civil Judgecum-First Class Magistrate, Bapatla, Guntur District. It is alleged that A4 and A5 introduced A1 and A2 to the de facto complainant and all of them stated to him that A1 and A2 are providing jobs. All the accused promised that A1 and A2 will provide a job to the son of the de facto complainant, and induced the de facto complainant to pay an amount of Rs.4 lakhs. But they neither provided any job nor returned the amount. The de facto complainant gave a report in the year 2007. After completion of the investigation, the police have filed charge sheet and the same was numbered as C.C.No.438 of 2009. Subsequently, the case against the petitioner was separated and numbered as C.C.No.167 of 2014.
Learned Counsel for the petitioner submitted that the case against A1 and A2 for the above offence ended in acquittal and that insofar as A3 is concerned, the de facto complainant compounded the offence, and subsequently, the de facto complainant died. Admittedly, the above crime pertains to the year 2007. The allegation against the petitioner is that he introduced A1 and A2, who induced the de facto complainant to pay the amount for the purpose of a job to his son. It is not disputed that the case against A1 and A2 ended in acquittal and the case against the other accused was compromised, and the de facto complainant was no more. Considering the facts and circumstances of the case, this Court is inclined to quash the proceedings against the petitioner. Accordingly, the Criminal Petition is allowed quashing the proceedings against the petitioner in C.C.No.167 of 2014 on the file of the Additional Junior Civil Judge-cum-First Class Magistrate, Bapatla,
Guntur District. Consequently, miscellaneous petitions pending, if any, shall stand closed.
