ORDER

The present criminal revision case is directed against the order dated 24.12.2014 passed in C.F.No.8390 of 2014 by the learned Chief Metropolitan Magistrate, Vijayawada.

2. Heard both sides.

3. The 2nd respondent herein filed a private complaint on 04.06.2015 against the petitioners/A1 to A7 stating that all the accused entered into the Church, break open the Donation/offering Box and took away the amount of Rs.81,665/- and earlier also, they had misappropriated the huge amount of Rs.2,63,934/-. By the order impugned, the trial Court forwarded the matter to the Station House Officer, I Town Police Station, Vijayawada, for investigation. Based on the said complaint referred to the police, a case in Cr.No.131 of 2015 of Vijayawada I Town Police Station, Vijayawada City, was registered against the accused for the offences under Sections 441, 380, 427 IPC read with Section 156(3) Cr.P.C. Aggrieved by the order impugned, the present revision is filed.

4. Learned counsel for the petitioners submitted that the trial Court without giving any specific reasons has forwarded the matter for investigation. He confined his arguments and prayed to direct the police concerned not to arrest the petitioners, if any

case is registered against them.

5. The allegation against the petitioners/A1 to A7 is that they have committed the theft of offerings in the offering box kept in the Church by breaking open the said box. They are arrayed as A1 to A7 in the said crime. It is the case of the petitioners that the trial Court without ordering for appearance of the petitioners before the Court to answer the accusation levelled against them has passed the said order.

In any case, considering the facts and circumstances of the case, this revision is disposed of, directing the Investigating Officer concerned to complete the investigation without arresting the petitioners/A1 to A7.

6. With the above observation, the Criminal Revision Case is disposed of. Miscellaneous petitions, if any, pending in this revision shall stand closed.
